Island Cuisine Terms and Conditions Agreement

1. Force Majeure 1.1. Client acknowledges that events such as storms, significant utility interruptions, natural disasters, the spread of infectious disease (pandemics), and Territory/State relocations are beyond Island Cuisine’s control. Consequently, it may be necessary to reschedule your booking or order without any liability on Island Cuisine.
2. Payments and Refunds 2.1. All sales are FINAL. Amounts paid are non-refundable, except as transferable credit for approved Island Cuisine products or services. All paid reservations, confirmations, and final paid bookings apply.

2.2. Clients are required to pay charges for services and accommodations as follows:

• Option 1: Payment in full upon signing.
• Option 2: Payment in two increments with the first increment not less than 50% of the total catering services upon booking. The second increment must be paid in full 72 hours (3 days) prior to the event. If the second installment is not paid, Island Cuisine will assume the first installment covers the guaranteed number of guests expected.

1. Guest Guarantees and Overages

3.1. The client must provide a final guarantee of the number of attendees at the time of signing this contract. Island Cuisine will provide services and accommodations for the specified number. If additional guests are served beyond the guaranteed amount, the client will be required to pay for these services. Tentative bookings are held for 48 hours, after which they may be canceled.

1. Function Discrepancies and Quality Assurance

4.1. Any discrepancies and quality issues must be reported within 24 hours after the function. Both Island Cuisine and the event representatives will investigate and resolve any issues. Any partial reimbursements, credits, costs, and charges will be addressed within 15 calendar days.

1. Food and Beverage Policies

5.1. Following Guam’s Health and Safety and Alcohol Beverage Control Regulations, the client must provide a list of food items brought by other guests. Island Cuisine does not include service charges for other foods/beverages not provided by Island Cuisine.

5.2. In the event the client receives additional food items, they must also provide additional paper products. If additional protein is added to the buffet line, the client must order additional starch to accommodate these items. The additional starch may be ordered from Island Cuisine or another source. If these outside foods will not be managed by Island Cuisine team members, the client must ensure the starch is also ordered from another vendor.

1. Conduct and Service Refusal

6.1. Island Cuisine reserves the right to exclude or dismiss any persons from the function or premises without liability.

6.2. The client shall conduct their function in an orderly manner, complying with Island Cuisine’s management rules and all applicable laws, ordinances, and regulations.

6.3. Island Cuisine reserves the right to refuse service if any attendee becomes belligerent, abusive, non-compromising, or verbally/physically violent towards Island Cuisine staff.

1. Additional Services and Charges

7.1. If Island Cuisine provides additional services or accommodations not specified in this agreement, the client shall pay for these charges immediately upon receipt of the bill. If not paid, these costs shall become due under this agreement.

7.2. Island Cuisine does not service outside food but will allow donated outside food to share an additional table spot within the buffet area, with no liability to Island Cuisine. Event representatives must provide tables.

7.3. Island Cuisine will not provide additional paper products and beverages beyond the guaranteed amount of guests.

1. Responsibility and Liability

8.1. Island Cuisine is not responsible for instruments, equipment, or personal belongings left by the client or any invitees on Island Cuisine premises during and after the function.

8.2. The client agrees to begin the service promptly at the scheduled time and comply with Island Cuisine's function terms. Any overtime charges incurred due to exceeding the designated service time (4 hours maximum) must be compensated by the client.

8.3. Contract Signer/Official event Representative will provide portable containers with lids, aluminum pans with foil, and beverage igloos will be provided to store leftover food and beverages from the event.

8.4. An appointed event representative must audit and verify the condition of all leftover food.

8.5. Once food is delivered and received by the designated event representative, the representative assumes responsibility, removing all liability from Island Cuisine.

1. Image Use Permission

9.1. Permission is granted to Island Cuisine to use any images created under this contract for professional samples, displays, internet website pages, advertising, exhibitions, contests, and any other purpose.

1. Governing Law 10.1. This agreement shall be governed by the laws of Guam.
