Island Cuisine TERMS and CONDITIONS and AGREEMENT
1 A. Client acknowledges that due to storms, significant utility interruptions, acts of natural disasters, spread of infectious disease (Pandemic), and Territory/State relocations are beyond Island Cuisine’s control. It may be necessary to cancel the function (s) or to reschedule if it’s possible, without any liability of Island Cuisine to Client.
1 B. Under Island Cuisine Terms, Conditions, and Agreement. Client acknowledges that all sales are FINAL. The amount paid is non-refundable. Not limited to APPROVED Island Cuisine Product or Service as transferable Credit. All PAID RESERVATIONS/CONFIRMATIONS, AND OR FINAL PAID BOOKINGS APPLY.
1 C. Under Island Cuisine Catering Terms, Conditions and Agreement, it is required that all charges for services and accommodations provided by ISLAND CUISINE shall pay in full upon signing (Booking via this website or walk in).
2 A. Client must advise Island Cuisine on the day of signing this contract booking a final guarantee of the number of persons who will be in attendance of the function. Island Cuisine will only be required to provide services and accommodations for the specified amount. Further, if Island Cuisine serves people more than the guaranteed amount, the client will be required to pay for such services. (TENTATIVE BOOKINGS HELD FOR 48 HOURS. AFTER SUCH TIME A BOOKING MAY BE CANCELED).
2 B. Function discrepancies and Quality assurance discussed 24 hours after the function has ended. At such time any matter concerning the service in regard to any discrepancies, mishaps, and or damages will be further investigated by all participating parties. Until both Island Cuisine and event representatives reach an agreement. Any partial reimbursements, credits, costs, and charges will be released or received within 15 calendar days.
3. Following Guam’s Health and Safety and Alcohol Beverage Control Regulations, the client must provide a list of food items that will be brought by other attending guests. Island Cuisine does not include service charges for other foods/Beverages that donate by other guests not employed under Island Cuisine.
4. Island Cuisine reserves the right to exclude or dismiss any persons from the function, or Island Cuisine catering premises, without liability on the part of Island Cuisine.
5 A. the client shall conduct their function in an orderly manner, and in full compliance with the rules of Island Cuisine management, and with all applicable laws, ordinances, and regulations.
5 B. Island Cuisine will exercise the RIGHT TO REFUSE SERVICE in the event: Signee and or guest of the event becomes BELIGERANT, ABUSIVE, NON-COMPROMISING, and VERBALLY OR PHYSICALLY VIOLENT to ALL Island Cuisine TEAM, affiliated members.
5 C. In the event of the breach of this Agreement by Client, Island Cuisine reserves the right to cancel the Banquet Function without any liability on the part of Island Cuisine to Client.
6 A. If Island Cuisine, at the request of the client, furnishes any food, beverage, or any other services or accommodations not contemplated by this Agreement, Client shall pay Island Cuisine the charges therefore immediately upon receipt of the bill. If not paid, the costs shall become due under this agreement even though not specified in this agreement.
6 B. Signee understands and acknowledges that Island Cuisine will not and does not service outside food. However, Island Cuisine will allow donated outside food to share an additional table(s) spot within the immediate buffet area at no liability to Island Cuisine. (Event representative must provide tables)
6 C. Signee agrees that Island Cuisine will not provide any additional PAPER PRODUCTS, and BEVERAGES after Island Cuisine achieves the guaranteed amount of guests.
7. The client acknowledges that Island Cuisine shall not be responsible for instruments, equipment, or personal belongings left by the client or any of the client’s invitees at Island Cuisine premises during and after the function.
8 A. Client agrees to begin its service promptly at the scheduled time and complies with Island Cuisines function terms stipulated in this agreement. Should the event exceed, the designated hour indicated, the client further agrees to compensate Island Cuisine for any overtime wages or additional charges incurred. (4 hours maximum allotted service time Dept of Public Health allows for Food Shelflife)
8 B. Client acknowledges that portable containers with lids or Aluminum pans with foil and Beverage igloos will be provided to store any and or leftover food and beverage from the event as stipulated in this agreement.
8 C. Client acknowledges that all leftover food received shall be audited by an appointed event representative to obtain and verify the condition of all leftover food of their event.
8 D. Client Acknowledges and understands that once all foods are delivered and received by the designated or assigned event representative. Representative assumes responsibility and removes all liability on the part of Island Cuisine.
Permission is at this moment granted to ISLAND CUISINE to use any images created under this contract for professional samples, displays, internet website pages, advertising, exhibitions, contests, and any other purpose. The laws of Guam shall govern this agreement.
